Welcome to Sylvart Studios. These Terms of Service (“Terms”) govern your access to and use of our photography services, products, and website. By booking a session, purchasing a product, or interacting with us, you agree to comply with these Terms.

1. Services Provided

We offer professional photography services, including but not limited to portrait sessions, event photography, and specialty photography products. The scope of services will be outlined in your booking confirmation or contract.

2. Booking and Payments

Deposits and Fees: A non-refundable deposit is required to secure your session date. Full payment for services or products is due by the specified deadline.

Rescheduling: Rescheduling requests must be made at least 15 Business days in advance. Rescheduling is subject to availability.

Cancellations: Cancellations will forfeit the deposit.

3. Session Policies

Arrivals: Please arrive on time for your session. Late arrivals may result in reduced session time without a refund.

Conduct: We reserve the right to end a session early if behavior during the session is unsafe, disruptive, or inappropriate.

Participation: If children or pets are part of the session, a responsible adult must be present to supervise.

4. Image Delivery and Editing

Proofs and Final Images: Previews will be available within 12 business days of your session. Final orders will be available within 6-10 weeks of your order date.

Editing Standards: Basic retouching is included with some products. Extensive editing (e.g., body modifications) may incur additional fees.

Image Format: If digital files are provided, they will be in JPEG format unless otherwise specified. Raw or unedited files will not be released.

5. Copyright and Usage Rights

Client Usage: You are granted a non-exclusive, non-transferable license to use purchased images for personal use and display. No additional grant of rights is included.

Commercial Use: Commercial use of images is prohibited unless expressly authorized in writing. All Commercial Usage to be negotiated separately.

Promotional Use: We may use your images for promotional purposes (e.g., portfolio, social media).

6. Refunds and Satisfaction Guarantee

Deposits and Payments: Deposits are non-refundable. Other payments are refundable only in the event of service cancellation by the studio.

Satisfaction Guarantee: If you are unsatisfied with your images, we will work with you to resolve concerns within reason. This does not include refunds or reshoots due to subjective preferences.

7. Limitations of Liability

Studio Responsibility: While we take great care to ensure quality and safety, Sylvart Studios is not liable for:

Circumstances beyond our control, such as weather or equipment failure.

Accidental loss or damage to personal items during a session.

Unforeseen delays in image delivery due to technical issues.

Maximum Liability: Our liability for any claim is limited to the amount paid for the session or product in question.

8. Client Responsibilities

Preparation: You are responsible for arriving prepared and on time. This includes wardrobe, grooming, and any required props.

Accuracy: Ensure all information provided (e.g., contact details, preferences) is accurate.

9. Privacy

Your personal information is handled in accordance with our [Privacy Policy]. We are committed to protecting your data and respecting your privacy.

10. Messaging Policy

By providing your phone number, email address, or other contact details, you agree to receive communication from Sylvart Studios regarding:

Appointment reminders, confirmations, and updates.

Follow-ups related to your session or product orders.

Special offers, promotions, and announcements (if opted into marketing communications).

We may use SMS, email, or third-party messaging apps (e.g., WhatsApp, Facebook Messenger) for these purposes. Standard messaging or data rates may apply based on your mobile carrier plan.

Opt-Out: You may opt out of marketing messages at any time by following the instructions provided in the message (e.g., replying "STOP" to SMS) or contacting us directly.

Responsibility: You are responsible for providing accurate contact information and ensuring your messaging preferences are up to date.

Messaging Terms & Conditions

11. Governing Law

These Terms are governed by the laws of Ohio, without regard to conflict of law principles.
